Terms of Service

These Terms of Service (“Terms”) are a legal agreement between you and Drive107 (“Drive107”, “we”, “us”) governing your access to and use of our website, web application, and related services (the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility & accounts

You must be at least 16 years old (or the age of digital consent in your jurisdiction) to use the Service. You are responsible for the information you provide, for keeping your account credentials secure, and for all activity that occurs under your account. Notify us promptly of any unauthorized use.

2. Acceptable use

You agree not to:

  • Use the Service in violation of any law or the rights of others.
  • Upload content that is unlawful, infringing, harmful, or that you do not have the right to share.
  • Attempt to access accounts or data that are not yours, or probe, scan, or breach security measures.
  • Interfere with, overload, or disrupt the Service or its infrastructure, including through automated scraping or excessive requests.
  • Reverse engineer or attempt to extract source code except where permitted by law.

3. Your content

You retain all rights to the content you add to the Service — including vehicle records, photos, and documents (“Your Content”). You grant us a limited, non-exclusive license to host, store, process, and display Your Content solely to operate and provide the Service to you and the people you authorize. You are responsible for Your Content and for having the rights necessary to upload and share it.

We do not claim ownership of Your Content and will not use it to train third-party advertising systems or sell it. We may remove content that violates these Terms or the law.

4. Public pages & shared access

The Service lets you make a vehicle page public and invite others to view or help manage your vehicles. If you publish content publicly, you are responsible for it and understand that it may be viewed, cached, or indexed by others. If you invite people to your account, you are responsible for the access you grant them. We are not responsible for how authorized users or the public use information you choose to share.

5. Plans & payments

The Service may offer free and paid plans. Features, limits, and pricing for paid plans are described at the point of purchase and may change. If you purchase a paid subscription, you authorize us (and our payment processor) to charge the applicable fees on a recurring basis until you cancel. Refunds and cancellations are governed by our Refund Policy. You can cancel at any time; cancellation takes effect at the end of the current billing period and you retain plan access until then.

6. Third-party data & services

The Service integrates third-party data and providers — for example vehicle databases, recall and safety information, fuel-economy data, and address lookup. This information is provided by those sources “as is” and may be incomplete or inaccurate. Drive107 is an organizational tool and does not provide safety, mechanical, legal, or professional advice. Always verify safety-critical information, including recalls and maintenance requirements, with the manufacturer or a qualified professional.

7. Intellectual property

The Service, including its software, design, logos, and content (excluding Your Content), is owned by Drive107 and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with these Terms. You may not copy, modify, distribute, or create derivative works from the Service except as expressly permitted.

8. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any data (including third-party vehicle or recall data) is accurate or complete. You use the Service at your own risk.

9. Limitation of liability

To the maximum extent permitted by law, Drive107 and its suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from or related to your use of the Service. To the maximum extent permitted by law, our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim, or USD $50.

10. Indemnification

You agree to indemnify and hold harmless Drive107 from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from Your Content, your use of the Service, or your violation of these Terms or the rights of others.

11. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms, if required by law, or to protect the Service or other users. Upon termination, your right to use the Service ends; sections that by their nature should survive (such as content licenses you’ve granted for already-shared content, disclaimers, limitations of liability, and indemnities) will survive.

12. Changes to the Service & Terms

We may modify or discontinue features of the Service, and we may update these Terms from time to time. When we make material changes to the Terms, we will update the “Last updated” date above and, where appropriate, notify you. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

13. Governing law

These Terms are governed by the laws of [your governing jurisdiction], without regard to its conflict-of-laws rules. You agree that the courts located in that jurisdiction will have exclusive jurisdiction over any disputes, except where applicable law gives you the right to bring a claim elsewhere.
